Refund & Cancellation Policy
Effective date: October 3, 2026
MAX AUTO Co. ("MAX AUTO", "we", "us") exports used vehicles from the Republic of Korea. Every vehicle we sell is a used vehicle, sold in its documented condition. This policy explains when you can cancel an order, when we refund your payment, and how claims are handled. It applies to every vehicle purchased from MAX AUTO through maxkauto.com, your customer account at account.maxkauto.com, or our official sales channels. By paying a Pro Forma Invoice (PI), you agree to this policy.
1. Key points
- You may cancel free of charge at any time before you pay.
- We refund 100% of the amount we received if we cannot supply or ship your vehicle for reasons on our side (Section 4).
- After we have purchased your vehicle, cancellation for any other reason is subject to charges (Section 5).
- Once export preparation has started or the vehicle has been shipped, the sale is final.
- Vehicles are sold as documented: in the condition shown in the photos, videos, inspection report, insurance history and PI we provide before you pay.
- Claims must be reported within 7 days of the vehicle's arrival at the destination port, with evidence (Section 7).
- Refunds are paid only in USD by bank transfer to the account that sent the payment.
2. Definitions
- PI (Pro Forma Invoice): the invoice we issue in your MAX AUTO account, stating the vehicle, price, Incoterm, payment due date and our bank details.
- Vehicle Price: the price of the vehicle itself on the PI, excluding freight, insurance, inspection and other charges.
- MAX Signature vehicle: a vehicle held in MAX AUTO's own stock.
- Marketplace vehicle: a vehicle offered by a partner dealer in Korea, which we purchase for you after receiving your payment.
- Purchase: the point at which we buy the vehicle from the seller or, for a MAX Signature vehicle, confirm your payment and reserve it for you.
- Export Preparation: export deregistration, transport to the port, export customs filing or shipment booking — whichever happens first.
- Shipment: loading of the vehicle on the vessel or into a container, evidenced by the Bill of Lading (B/L).
- Arrival: the date the vessel arrives at the destination port stated on the B/L, as reported by the carrier.
3. Before you pay
- Quotations and PIs are free and do not oblige you to buy. You may cancel at any time before payment.
- Prices, availability and freight rates are confirmed only on the PI and only until its due date.
- A vehicle is not reserved for you until we confirm your payment, unless your PI states a reservation period.
- If we do not receive cleared funds by the PI due date, the PI expires and the vehicle may be offered to other buyers. Any amount already received is handled under Section 5.
4. Full refund (100%)
We refund 100% of the amount we received from you, with no cancellation fee, if:
- The vehicle is no longer available — for example, the dealer sold it before our Purchase, or we cannot complete the Purchase.
- A material problem is found before Shipment that was not disclosed in the listing, inspection report, insurance history or PI — for example, undisclosed structural or flood damage, a different VIN or model year, an odometer inconsistency, or a registration, lien or legal issue that prevents export.
- We cannot export the vehicle for reasons within our control.
- We do not ship the vehicle within 45 days after receiving cleared full payment and your complete, correct consignee details, for reasons within our control.
In cases 1 to 3, you may instead choose a replacement vehicle or, where we offer one, an agreed price adjustment. We pay our own bank's sending charges for these refunds. Charges deducted by your bank or by intermediary banks are outside our control.
5. Cancellation by the buyer after payment
If you cancel for any reason not listed in Section 4 — for example a change of mind, a change in your market or a delay on your side:
- Payment received, before Purchase (Marketplace vehicles only): we refund the amount received, less an administration fee of USD 300 and bank charges.
- After Purchase, before Export Preparation: we refund the amount received, less a cancellation fee of 20% of the Vehicle Price (minimum USD 1,000), costs already incurred and bank charges.
- After Export Preparation has started, or after Shipment: the order cannot be cancelled and no refund is due.
Costs already incurred include inland transport, storage, inspection or certification fees, document and courier fees, and any freight or booking cancellation charges. Cancellation after Purchase requires our written confirmation. If you do not pay the balance of a PI by its due date, we may treat the order as cancelled by you under this section.
6. Documentation and your acceptance
- Before you pay, we provide photos, videos, the inspection report and the insurance history for the vehicle. Please review them carefully and ask any questions before paying.
- Your payment confirms that you accept the vehicle in the condition documented in those materials.
- Conditions documented before your payment — including disclosed accidents, repairs, replaced panels, wear, scratches and recorded mileage — cannot be the basis of a later claim or refund.
- Mileage is reported as displayed on the vehicle and recorded in Korean records at the time of inspection.
7. Claims after arrival
If the vehicle you receive differs materially from what we documented before Shipment:
- Report it within 7 days of Arrival through your MAX AUTO account, by email or on WhatsApp, quoting your PI number.
- Send clear photos and a video showing the VIN and the issue.
- Do not repair, dismantle, modify or register the vehicle before we reply. Doing so may invalidate the claim.
- We may ask for an inspection by an independent inspector. If the claim is accepted, we reimburse that cost.
- We reply within 10 business days of receiving complete evidence.
A claim can cover: a material difference between the vehicle and our written documentation that existed before Shipment and was not disclosed — for example a different VIN, model year or major specification, or undisclosed structural or flood damage.
A claim cannot cover:
- mechanical or electrical problems that appear after Shipment, during the voyage or after Arrival;
- normal wear and tear of a used vehicle, cosmetic marks, and consumable parts (tyres, batteries, brakes, filters, fluids, wipers, bulbs and similar);
- conditions documented before your payment;
- damage, loss or theft during transport, loading, unloading or storage after Shipment (see Section 8);
- items not listed in our documentation, such as spare keys, manuals, mats, tools or navigation map data;
- whether the vehicle meets the import, registration, emissions, age or technical rules of your country (see Section 9);
- delays, duties, taxes, port charges, storage or demurrage at destination.
Remedies: if we accept a claim, we will, at our choice, (a) pay a partial refund for the verified difference, or (b) reimburse reasonable repair costs that we approve in writing before work starts. If the vehicle supplied is not the vehicle documented on your PI, we will agree a full solution with you, which may include a refund once the vehicle is returned to us on terms agreed in writing.
8. Shipping, risk and insurance
- Risk in the vehicle passes to you according to the Incoterm on your PI. Under FOB, CFR and CIF terms, risk passes when the vehicle is loaded on board at the port of loading in Korea.
- After that point, damage or loss in transit is handled by the carrier and the marine insurer, not by a refund. We strongly recommend marine insurance (CIF) and will help you file a claim under any policy we arranged.
- Shipping schedules, transit times and arrival dates are carrier estimates. Delays caused by carriers, weather, port congestion, customs inspections or other events outside our control are not grounds for cancellation or refund.
9. Your responsibilities
Before paying, please confirm with your local authorities or customs broker that the vehicle can be imported and registered in your country (for example age limits, steering side, fuel type, emissions and inspection rules), and give us accurate consignee and notify-party details. Refunds are not available if a vehicle cannot be imported or registered because of local rules, incorrect details you provided, or documents you were required to supply.
10. Non-refundable charges
Unless a refund is due under Section 4, the following are not refundable once paid or incurred: bank, intermediary bank and currency conversion charges; third-party inspections or certificates required for your destination; freight, booking and cancellation charges of shipping lines once a booking is made; courier and document legalisation fees; and storage charges caused by delays on your side.
11. How refunds are paid
- Refunds are paid in USD by bank transfer only to the account that sent the original payment, in the same account holder's name. We do not refund to third parties, in cash, by card or in cryptocurrency.
- Refunds are calculated on the USD amount credited to our account. We are not responsible for exchange-rate differences.
- When a refund is approved, we issue a Refund Confirmation in your MAX AUTO account. Section 4 refunds are paid within 10 business days of that confirmation; Section 5 refunds within 30 days.
- We can only refund money that reached MAX AUTO's business account shown on your verified PI. We cannot refund payments sent to any other account, even if the recipient pretended to be MAX AUTO. Please read our Payment Safety page before paying.
12. Events outside our control
If war, sanctions, export or import bans, changes in law, port closures, natural disasters or similar events prevent the export or shipment of your vehicle, we will first try to agree an alternative with you. If none is possible, we refund the amount received, less third-party costs already incurred that we cannot recover.
13. Limitation of liability
To the extent permitted by law, our total liability for any vehicle is limited to the Vehicle Price we received for it. We are not liable for indirect or consequential losses, such as loss of profit, business or resale opportunity.
14. Your statutory rights
Nothing in this policy excludes or limits any right you have that cannot be excluded or limited under applicable law.
15. Governing law and disputes
This policy is governed by the laws of the Republic of Korea. We will first try to resolve any dispute with you in good faith within 30 days. If it cannot be resolved, the Incheon District Court, Republic of Korea, has jurisdiction, unless mandatory law where you live provides otherwise.
